Regular Meeting                               August 23, 2011

Crow Wing Town Hall                     6:00 p.m.

Board Members Present: Chairman Mark Platta, Supervisors Greg Smith and Dave Schultz and Clerk Virginia Rogers and those on the attached public roster.

Mark called the meeting to order and the pledge to the flag was recited.

No gopher bounties were claimed.

Planning and zoning items were discussed. There appears to be no progress on the Anthony violation and further complaints have been received.  A phone call from attorney Steve Qualley had been received. He will appear on August 29th for the Engholm hearing and ask that it be continued to a later date. After tonight’s inspection of the property a date will be suggested by the town board, depending on whether or not it looks like the August 31st deadline will be met by Mr. Engholm.

Curt Engholm was present to discuss his violation. He stated that progress has been slow and meeting the August 31st deadline doesn’t look promising. He was informed that once the August 31st deadline passes, any further expenses regarding the violation will be billed to him and if unpaid, assessed to the property.  The school bus formerly on the property was sold for scrap, with the contents unloaded and stored in a trailer on the property. Discussion followed. Curt stated that he would be putting up a lean-to that will accommodate some of the debris. He was informed that he would not be able to get a land use permit to do this as long as his property is in violation. He was not aware that he needed a permit to build a structure with no foundation.  Curt stated that he will be constructing a fence. Mark noted that a fence is only required for a salvage yard. Erecting a fence would not change the requirement to remove these items, since this is a residential property.  Mark reviewed the situation. There is a deadline of August 31st. Curt has asked for an extension to October 15th. Mark made a motion to extend the deadline for cleanup to October 25th with the court date set for after that. Upon inspection on October 25th, if the violation has not been resolved, no further negotiations will be possible and the town board will do nothing further. Cleanup by the township will ensue with all expenses charged to the property owner and assessed to property taxes if remaining unpaid.  The motion was seconded by Greg. Any fees incurred beyond August 31st will be billed to Curt and if not paid by November 30th they will be assessed to the property.  Curt was asked if he needed assistance determining which items require removal. He stated that he knows what has to go and does not need to be told. Greg offered to bring his trailer over at Curt’s request to make a trip to the landfill. The motion passed unanimously. A letter will be sent to Isla Engholm, the property owner, informing her that Curt has stated he will not meet the August 31st deadline and of the impending billing for expenses and notifying her of the extension to October 25th before the township begins the process of cleanup. Beyond October 25th the township will do nothing further to assist in cleanup.  A copy will be sent to Curt as well.

The minutes of the August  9th meeting were reviewed. Greg made a motion to approve the minutes as written. The motion was seconded by Dave and carried by unanimous vote.

Payroll was approved and paid and correspondence was reviewed.

 The meeting was adjourned at 8:00 p.m. by general consent. The next meeting will be September 6, 2011.
