Regular Meeting September 12, 2017 6:00pm Crow Wing Town Hall

Board Members Present: Chairman Greg Smith, Supervisor Dave Schultz, Supervisor Doug Kern, Treasurer Sue Kern.

Greg called the meeting to order at 6:00 pm and the pledge to the flag was recited.

There were no gopher bounties.

Tom Feierabend and Jim Kramer were in attendance to discuss the preliminary plat of Oak Ridge South Second Edition. Last month the Town Board sent the preliminary plat application 17-4516 for Oak Ridge South Second Addition back to the planning commission for further review. After reviewing additional information including an updated layout for structures/SSTS, soils report and a stormwater management plan for the proposed road, the planning commission is recommending approval of the Preliminary Plat of Oak Ridge South Second Addition based on the following findings of fact and with the following conditions of approval:

FINDINGS OF FACT

1. Oak Ridge South is a proposed subdivision consisting of seven 2.5 acre lots and a public road/cul-de-sac.

2. The subject property is 18.41 acres and is located at the south end of Lone Oak Circle (no physical address).

3. The subject property will be created via an approved metes and bounds subdivision application (17-4511). The approved subdivision has not been filed at the county.

4. The subject property is in the Rural Residential 2.5 land use classification.

5. The property is adjacent to other property zoned Rural Residential 2.5 (north and east), Agricultural/Forestry (west and south) and Public(southwest).

6. The proposed lots are intended for single family residential purposes.

7. Each lot will be served by private water wells and private subsurface sewage treatment systems (SSTS). SSTS site evaluations have not been submitted for the development.

8. The property is mostly wooded and contains approximately three acres of delineated wetland in the southwest corner of the property.

9. The property does not contain any area designated as floodplain.

10. The proposed development contains a recently constructed road (extension of Lone Oak Circle) with a cul-de-sac. The proposed right-of-way is 66' wide (24' wide driving surface with 2' shoulders) and an 80' radius cul-de-sac. The applicant proposes to dedicate the road to the public.

11. Each of the proposed lots meet the minimum size and dimensional requirements of the Rural Residential 2.5 land use classification.

12. The proposed buildable area of the lots are:

Lot 1: 92,200 sf; Lot 2: 92,500 sf; Lot 3: 86,900 sf; Lot 4: 33,600 sf; Lot 5: 34,900 sf; Lot 6: 81,500 sf; Lot 7: 88,000 sf.

13. Covenants for the development have been submitted.

14. A grading plan for the proposed road in the subdivision has been submitted.

15. A wetland delineation report for the subject property dated 7/10/17 has been submitted.

16. The subject property is relatively level and no significant grading is necessary to create buildable lots. The Township has determined an overall grading plan is not necessary for the development.

17. A grading/stormwater management plan created by Anderson Bros. has been submitted for the proposed platted right-of-way (roadway).

18. A grading/stormwater management plat created by Stark Engineering has been submitted.

19. Statements from Fletcher Trucking and Anderson Brothers Construction have been submitted regarding site preparation for the roadway.

20. A copy of the NPDES permit for the project has been submitted.

21. An SSTS site evaluation for each of the proposed lots has been submitted.

22. A report with the description of the soils on the site and soil test results demonstrating the adequacy of the property for proposed development in terms of ground water level has been submitted. Three locations within the development were sampled.

Dave noted that the roads need to be tied together as they are developed so we do not end up with a lot of cul-de-sacs. Tom said the rest of the land will be a buffer zone. There will be a drainage pond installed for the plat and Tom said he will take out the beaver dam and pond on the adjacent property. Greg brought up that the sewer systems on lots 4 and 5 will need to be located as proposed when the construction permits are issued. The future Developers Agreement that is required was discussed. Tom will maintain the road and will need to pay for a stop sign. There will be a separate maintenance agreement on the road. Doug made a motion to accept the preliminary plat of Oak Ridge South Second Edition with the above Conditions of Approval. Seconded by Greg, motion passed.

Dick Herald from Bannick Logging was present to discuss the logging that will take place next December with the trucks coming out on Brandon Way, then using Canary Street to TH 371. The trucks will meet the 7 tons per axle load limit. They estimate taking 800-1000 cords of wood from the property.

The Engholm property is being listed with a realtor. The Chad Jillson violation has been turned over to the attorney. The Wade Tomberlin, Dale Dillon, Josh Neelan and Martin Copa property violations were discussed. There have been no changes.

Under public comments it was mentioned that the recycling dumpsters are working out better with the weekly pickups.

The Treasurer's report and claims were reviewed and approved.

Road issues were discussed. There are 3 places in the trailer park where vehicles are parked in the right-of-way. Dave has one more day of mowing to finish all the township roads. He had to fix the clutch on the tractor. Dave attended the Fire Advisory Board meeting. The Fire Department plans to buy 7 trucks in the next 6 years. The parts for the playground equipment are almost ordered. Just waiting for the supplier to call back.

Tri city will put Class 1 on Cook Road up to Forest Heights Drive for $15/ton and $3/gallon for tack, with 3' shoulders. It will cost about $9,000, Anderson Brothers' bid was $15,918. Greg made a motion to have Tri-City Paving shoulder and tack Cook Road from CR 45 to Forest Heights Drive. Doug seconded, motion passed.

Tri-City will rip-rap the culverts on 50th Avenue as discussed for the original price of $460 each, total $920, Anderson's bid was $4,626 to extend the culverts. Greg made a motion to have Tri-City Paving rip-rap culverts on 50th Avenue. Doug seconded, motion passed.

They also said they didn't forget about the pavement damage on 50th. The work will be done later this fall after paving is completed. The township truck is back at Dave's house. It is not fixed. Mills GM thinks it needs a new fuel injector pump for $2,400. The fuel lines are also leaking and it will take 8 hours labor plus parts to repair. That is a total of approximately $4,000 to repair it. The truck is a 1996 model and we have spent $2,000 to $3,000 in repairs the last few years. A new truck would cost about $50,000 outfitted similar to the current one. Others would be available for less without the dump box. Greg suggested that Dave check the cost of repair with another shop, but continue to check for a used one. MNCOMM finally fixed the damaged culvert on Wetherbee Road. The shoulders have not been fixed yet, but Dave was told they would be done this Thursday.

Correspondence was reviewed. The minutes from the Crow Wing County Highway Department City-County-Township Meeting on 7/24/2017 was received. The Markuson property contract has been canceled by the county.

Doug made a motion to approve the minutes from August 22, 2017. Dave seconded, motion passed.

Meeting adjourned at 8:09 pm.
